1. About These Terms

These Terms of Service (“Terms”) govern your use of MarkMate (accessible at markmate.education), an AI-powered assignment feedback tool. By creating an account or using MarkMate, you agree to these Terms. If you do not agree, please do not use the service.

2. The Service

MarkMate provides:

• AI-powered analysis of student work against teacher-defined rubrics
• Feedback including grades, annotations, writing coaching, and vocabulary suggestions
• AI detection indicators for teachers (not conclusive evidence of AI use)
• Assignment creation and management tools for teachers
• Self-check tools for students

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• Students under 16 must have parental or guardian consent to create an individual account. School-administered access is covered by the school's consent.
• You may not share your account with others or allow others to access your account.

4. Acceptable Use

You agree NOT to:

• Use MarkMate to submit work that is not your own for the purpose of academic dishonesty
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to access other users' data or accounts
• Use automated scripts or bots to access the service
• Reverse-engineer, decompile, or attempt to extract the source code of the service
• Use the service in any way that could damage, disable, or impair the service

5. AI Feedback Disclaimer

MarkMate's feedback is generated by artificial intelligence and is intended as a formative learning tool only.

• AI-generated grades and feedback are indicative, not definitive. They should not be used as official assessment results.
• The AI may occasionally produce inaccurate, incomplete, or inconsistent feedback. Always defer to your teacher's professional judgement.
• AI detection indicators are not proof of AI use. They are patterns that may warrant further investigation. They must never be used as sole evidence of academic dishonesty.
• MarkMate does not guarantee any specific academic outcome or grade improvement.

6. Intellectual Property

• Your content: You retain ownership of all work you upload (assignments, rubrics, student responses). We do not claim ownership of your content.
• AI-generated feedback: Feedback generated by MarkMate is provided for your use. You may share it with students, parents, or colleagues as needed.
• Our service: The MarkMate platform, branding, design, and code are owned by MarkMate. You may not copy, modify, or redistribute any part of the service.

7. Free and Paid Plans

• MarkMate offers a free tier with limited usage (see current limits on the pricing page).
• Paid subscriptions are billed monthly or annually as selected at checkout.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• Refunds are handled on a case-by-case basis. Contact support@markmate.education for refund requests.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

8. Limitation of Liability

To the maximum extent permitted by Australian law, MarkMate is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to academic outcomes, lost data, or service interruptions. Our total liability is limited to the amount you have paid for the service in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms or use the service in a way that could harm other users or the service itself. You may delete your account at any time by contacting support@markmate.education.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the updated Terms.
